What Happens If I Am Served With Divorce Papers And Then We Decide to Reconcile?

 

If you are served with divorce papers, you should get legal advice as to how to proceed.  If you have decided to reconcile and no longer want to proceed with the divorce, then the respondent can ask the petitioner to dismiss the case without prejudice (meaning that you could refile again at a later date if you wish).  By doing this, you avoid any problems that may occur when you do not respond to being served with divorce papers within the 30 day period.  You could also simply not continue with the case, but if you do this you run the risk of the petitioner filing a default if things don’t work out since you did not respond in the allotted time when you were served.
