If your existing child support order is in California, then it usually can be modified in this state.
If you wish to modify an existing child support order, you would require an Order to Show Cause. This is usually needed when there is a change in circumstance such as loss of a job or other event that warrants a change in the child support payment. Legal Action Workshop can prepare the Order to Show Cause, file it with the court and assist with serving the other parent.
Child support is generally ordered by the court when a child lives with only one parent. The non-custodial parent, or the parent with whom the child does not live, is usually responsible for contributing a certain portion of his or her income to help support the child, even if the custodial parent has income of his or her own.
In California, child support is based on a computerized formula known as the Dissomaster. The Legal Action Workshop Attorneys can advise you as to what is the appropriate child support and what are your best options.. Our Attorneys can also help you make a request to the court for temporary child support while your Divorce or Legal Separation is in progress.
