Civil Matters

Civil matters encompass a wide range of disputes which usually center around Real Estate litigation and Business litigation.  When you are involved in a civil matter make sure that your attorney is:

  1. experienced in the area of the dispute
  2. adept at negotiation
  3. familiar with and experienced in the trial process

Hart Levin has extensive experience in all civil areas.  He takes a results oriented and aggressive approach to civil matters, whether on the plaintiff side or the defendant.  Attorney Levin likes to develop a strategy with his clients wherein he identifies the strengths and weaknesses of the case and creates a winning plan.  The most important aspect of any civil case is an analysis of the cost versus the potential value of the claim.  Attorney Levin's analysis of the case will contribute to the ultimate success of the case and will give concrete options to the client.  Levin works on an hourly basis, flat fee basis and, at times, on contingency depending on the particulars of the case.

Kinds of Civil Actions:

  • Unlawful Detainer Actions: this occurs when a landlord/owner serves the tenant with a Notice to Pay Rent or Quit, and the tenant does not comply; the landlord/owner is now able to take action to obtain a court order and regain the property of the tenant

  • Conversion Actions:  the plaintiff sues for the return of personal property that he/she claims the defendant took unlawfully

  • Breach of Contract Actions:  the agreement or contract can be written or verbal; the plaintiff claims that the defendant failed to comply with the contract i.e. he/she may not have provided goods or services or many not have paid for goods or services

  • Tort:  personal injury or property damage actions; the plaintiff has been injured or his/her property has been damaged due to negligence on the part of the defendant

There are several parts to a civil action.  Sometimes parts of the action can be prepared on an as needed basis.  This may apply to discovery, or the drafting of interrogatories, complaints, requests, answers or responses.  Attorney Levin can address each issue and give you a firm idea of the cost and time involved in the preparation of each part.
