In a legal separation, the parties remain as a married couple, but all other issues are addressed the same as in a divorce. Some examples of issues addressed in a legal separation are: division of property, division of debt, issues related to children and support issues.

A legal separation helps the couple divide debts, maintain benefits such as health care, and may have certain tax advantages. In addition, legal separation is an alternative for those who elect not to get divorced for religious or other reasons. A legal separation is filed in the courts just like a divorce.  Likewise, the spouse is served.  If the spouse does not respond, the couple may require a Legal Separation Agreement which, when signed and notarized, would specify the agreed upon issues, making a court appearance unnecessary.  A Legal Separation Agreement, if necessary, would require an additional flat fee.  If one spouse files a response to the legal separation, our attorney-assisted method can still be used. We would counsel the client, prepare necessary legal documents and could represent the client in court under ‘limited scope’—all for low flat fees.
