Should I Get a Divorce or an Annulment?

Many times people want an annulment of their marriage as opposed to a divorce.  This could be for religious reasons or other reasons.  However, there are very specific legal grounds for annulment.  The most often used reason for annulment is fraud that goes to the heart of the marriage.  An example of fraud is when a person marries someone for immigration reasons only.  An attorney can determine whether or not there are grounds for an annulment.  Nevertheless, most courts will allow for the filing of both divorce and annulment and based on the facts, the court will decide which one is granted.  If the filing is done in this way, then the petitioner (the one who files for divorce) does not need to pay filing fees twice if the courts reject the annulment option.
