There are only 3 things to look for when you need a Probate attorney—experience, experience, experience! Probate attorneys need to have experience so that they can take Probate cases through the court system in a timely manner. Each court may require different steps in order to complete the Probate. Attorneys need to be very familiar with the necessary steps in each court. Probate attorneys also need experience so that cases are filed correctly and comply with state and local rules as to the notification of creditors, as well as specified agencies and anybody having an interest in the estate. Probate attorneys also have to find and locate assets and in some cases sell assets through court procedures or specified authorization documents. Although Probate cases vary in complexity, from not being challenged to becoming challenged, all Probates are complicated procedures and should not be undertaken without an attorney.
