Spousal Support can be agreed upon by both parties or either party can request it. It can also be requested no matter the length of the marriage.

Temporary spousal support is usually based on 2 factors, namely differential in income and need. For a permanent spousal support order, many factors are taken into consideration such as length of marriage, education, health of the party as well as other factors.

It should be noted that spousal support in a long marriage (over 10 years) may be requested at any time. However, even though it may be requested, it doesn’t mean that it will be approved.
