It’s imperative to be divorced before one remarries. Often people will assume that they are divorced and rush to get married! This is not a wise decision.
Here are 3 points to consider:
- When a Divorce is finalized, you must have proof. Go to the court and get a copy of the Divorce decree or order it online.
- If you have married and realize that you are not divorced, you must complete the first Divorce and remarry the current spouse as this marriage is not valid.
- Do not make arrangements to remarry unless the Divorce is finalized and you have the Divorce decree.
If you need to complete the Divorce from the first spouse in order to remarry the second spouse, it is best to examine any court papers that you may have to determine what needs to be done. If you do not have paperwork then you will need to see if the court has any. If nothing can be found, the court process for Divorce will have to be started all over again. In California, a Divorce takes a minimum of 6 months and one day from the date of service.
