How to Prevent Common Problems in a California Divorce

A California Divorce can present unforeseen problems.  There are solutions to most common problems and there are ways to prevent these problems from occurring. Here are some ways to prevent common problems:

  1. agree as to which person should be the petitioner; remember, the person chosen should be the one who will follow through and complete the Divorce if it is uncontested and the respondent does not respond
  2. use the legal names on the paperwork, nicknames will not work
  3. make sure to consult with one of our experienced Divorce Attorneys so that you are sure as to your issues
  4. service is mandatory; if your spouse is not cooperative then enlist another adult or a process server to do the service
  5. once the spouse is served, he/she has 30 days to respond;  make sure to enter a ‘default‘ if the spouse has not responded after the 30 days
  6. if your spouse has responded, you will be in a contested Divorce so file for a trial date as soon as possible as it takes many months to secure one
