Legal Separation in California

A Legal Separation is not required in order to file for Divorce in California.  In addition, California Divorce laws do not require parties to be separated for a period of time in order to file for Divorce.  California Divorce laws do require a ‘date of separation’ and that is the date that the parties no longer live together as husband & wife.  The parties can reside in the same home and still have a date of separation.  Your Legal Separation Lawyer can explain.

Most people choose a Legal Separation for reasons such as:

  1. Their religion does not allow for Divorce
  2. There may be financial or healthcare advantages
  3. They may wish to address assets, debts or custody & support issues in a faster time frame (a Legal Separation can take 3 or 4 months to finalize whereas a Divorce takes a minimum of 6 months and 1 day from the date of service)
  4. There may be jurisdictional issues (different states involved or a possible move to another state)
  5. There may be other reasons

A consultation with the Legal Separation & Divorce Attorney can determine if there are appropriate reasons for a Legal Separation in California.

Be advised that a Legal Separation will address the issues as in a Divorce, but once finalized, the parties cannot remarry.  A Divorce will allow them to remarry.
