A Probate is the transfer of assets from the decedent to heirs or beneficiaries.  If the asset is a home, condo or other real estate and you want to sell, the monies from the sale would be used to pay administration costs which includes legal fees.  In a California Probate, real estate can be sold in 2 ways:

  1. court confirmation hearing–the advantage of which is that the hearing requires an auction which may bring over bids and therefore higher profits
  2. if there is a will, you may be able to sell the home without a confirmation hearing–the advantage of which may be a faster sale and may make it easier to obtain a buyer
