There are times when a Publication Divorce is needed. This often occurs when the parties are married but have lost touch with each other. This may occur as a result of a sustained argument wherein one party refuses to communicate with the other or when the parties have simply lost touch over an extended period of time. The divorce is based on the last known address.
In order to divorce, when one party does not know where the other party lives or works, one must file a Publication Divorce which includes specific steps which must be completed so that the divorce is approved by the court.
Steps to a Publication Divorce:
- file the divorce
- complete a Search for the party
- receive a letter from the manager of the nearest post office regarding a forwarding address
- request approval for publication
- publicize the divorce in a legally approved newspaper for 1 month
- enter final divorce documents
Once all steps are performed and correctly filed with the court, the court will usually approve the divorce. Be advised that this procedure takes longer than a typical divorce with agreement which may take as little as 6 months and 1 day from the date of separation. This type of divorce may take 9 months or may take years depending on the circumstance.
