Some people may want a legal separation, as opposed to a divorce, for religious or financial reasons. A person’s religious beliefs may not allow for a divorce. Likewise, one spouse may have a health plan from work which would be discontinued for the spouse if the parties divorced. There may be other reasons for a legal separation.
Nevertheless, a legal separation addresses the same issues as in a divorce—the difference being that once the legal separation is approved, the parties are not divorced and hence cannot remarry. If one or both of the parties wish to remarry, they would have to file for divorce and complete the divorce process.
A legal separation takes less time than the minimum time frame for divorce (6 months and 1 day from the date of service). A legal separation can take as little as 3 months to complete depending on the court.
