Same sex couples may have filed for a ‘domestic partnership’ or they may have married. In the case of a domestic partnership, the process would begin with a  termination of the partnership and would proceed as in a Divorce. When the partners are married, the dissolution of the marriage is the same as in any Divorce.

Couples who are divorcing have many concerns.  They will want to know what the Divorce will cost.  Beyond cost they will also want to know their legal rights as well as their options with regard to the court process. Here is a short list of possible issues that may impact the Divorce:

  1. length of marriage or domestic partnership and the possibility of partnership, or spousal, support
  2. assets and debts acquired during the marriage and division of property
  3. custody, visitation and support of children

There may be other issues as well. No matter what the specific circumstances surrounding the Divorce, the Attorney will assess the situation and advise the client. Once the client thoroughly understands his/her legal rights and what is reasonable, it is best to discuss, if possible, a compromise with the other spouse so that the Divorce or the termination of the domestic partnership can be as amicable as possible.

When there are issues, these can be addressed in an agreement so that a hearing or trial is not necessary. This would save the most money. However, when agreements cannot be forged, temporary orders and a trial may be needed.
