Making sure that your family is taken care of in the event of your passing is a good thing to think about as we approach 2012.  Failure to have a California Will or Trust prepared can make the transfer of assets difficult for heirs.

A California Will is important because:

  1. it can designate a guardian(s) for children and detail where they would live and how monies are to be used on their behalf
  2. it can nominate a person(s) who will inherit the estate
  3. it can explain how possessions should be divided

A California Trust is important because:

  1. it  avoids the cost & lengthy time of a Probate
  2. it expedites the transfer of assets
  3. it reduces legal fees
  4. it can give you options as to how to distribute assets

Many people are not aware of the importance of a California Will and Trust.  If a Will or a Trust is not prepared prior to death then heirs can be saddled with high fees, time constraints and confusion.  Further, if you wait too long to prepare these documents, then health issues may interfere with the ability to have these documents prepared.  This may occur if the owner of property and/or assets is ‘not of sound mind’ and is now unable to make decisions on his/her own behalf and therefore cannot have a Will or Trust prepared.

Some people think that they can do a Will or a Trust by using a document service or by filling out some forms online.  This is not a good idea because each person’s situation is unique and cannot be reduced to a ‘one size fits all’ approach.  The best approach is to speak with an Attorney for legal advice so that the Will and Trust is prepared according to your wishes and expectations and is legally correct.
