Legal oversight means that a Divorce Attorney will be available to answer questions and to make changes and additions as needed as your Divorce proceeds through the California court system.  It also means that when the unexpected occurs, there is an experienced Family Law Attorney who is available to provide solutions, prepare the necessary divorce papers and do additional filings as needed.

James (not his real name) came into our offices with what he called a ‘simple’ divorce.  He had some issues such as spousal support, division of property and the division of his 401K retirement fund.  The Attorney discussed his legal options and gave him an idea of what was reasonable in his case.  He went back to his wife and both had decided to agree with regard to the issues.  We filed the divorce and then served his wife by mail.  She signed & dated the Notice and Acknowledgment (Proof of Service) and sent it back to us in a timely manner.  James then asked us to proceed with a Marital Settlement Agreement, during the 30 day response period, which would address all of the issues of his divorce.  This agreement would avoid a court appearance.  However, just as the Marital Settlement Agreement was about to be prepared, James was served with an Order to Show Cause for temporary spousal support.  He also found out that his wife had hired an attorney and now no longer wishes to sign a Marital Settlement Agreement.  He was also served with a Response.

This scenario is not uncommon.  Many people make assumptions when they consider how to get a Divorce in California and are surprised to find that things do not proceed as predicted.  An experienced Attorney can help by explaining the legal options and keeping the Divorce on track.  Sound legal advice and oversight are the most important elements when considering a Divorce.  In this case, we were still able to assist with the Divorce by using our Flat Fee model.
